NON-ELECTORAL FACTORS OF THE LEGITIMACY OF THE PRESIDENT UNDER THE CONDITIONS OF THE LEGAL REGIME OF MARTIAL STATE

Abstract

The article examines the non-electoral factors of the legitimacy of the president under martial law. A relatively narrow period of time is taken, when it is impossible to hold elections, and the legitimacy of the government must provide something. Moreover, in the conditions of the impossibility of organizing the electoral process, non-electoral factors increase. The struggle for power, which politicians begin immediately after the elections, in the conditions of military danger, for a certain time made them statesmen who should think about society, the state. The material was written based on the results of research conducted by scientists of the Institute of Political and Ethnonational Studies named after I.F Kuras of the National Academy of Sciences of Ukraine, and includes all the power institutions in the complex. In this article, we will take from the research and analyze the data related to the presidential institute. For this, 10 instruments were defined, which are provided for by the Constitution of Ukraine and are his powers, and therefore their application is not limited to the framework of the legal regime of martial law in Ukraine. The survey was conducted by polling political scientists, sociologists, lawyers, journalists, state managers, scientists, etc. That is, those persons who are professionally involved in social and political processes in the country and can provide an assessment of the events of recent years. It showed the attitude of experts to authorities in terms of ensuring institutional capacity and performance of their functions, taking into account the agenda and requests of society. Actually, such empirical material became the basis for writing this article.
