REGULATORY AND LEGAL FRAMEWORK FOR OPEN DATA IN UKRAINE: FROM CONSTITUTIONAL GUARANTEES TO TECHNOLOGICAL STANDARDS

Abstract

The article analyzes the system of the regulatory and legal framework for open data in Ukraine as a fundamental instrument for ensuring government transparency and the digital transformation of public administration. The evolution of the legal framework is explored: from constitutional guarantees of the right to information to detailed standards enshrined in the Law “On Access to Public Information” and Resolution of the Cabinet of Ministers of Ukraine No. 835. Particular attention is paid to the substantive transformation of openness principles, specifically interoperability, which in modern conditions is viewed not merely as a technical requirement but as a comprehensive standard for the quality and compatibility of public information The role of public authorities as key data administrators is justified, as their activities directly influence the level of democracy and openness within the political system. The technological aspects of implementing state policy are highlighted, including the introduction of Application Programming Interfaces (APIs) and the concept of “high-value datasets” (HVD). The transition to automated processing and ensuring the stable operation of digital infrastructure is a necessary condition for building a modern digital state system. Critical barriers to ensuring access to open data are identified, related to the imperfection of administrative liability mechanisms and the complexity of identifying responsible persons within government structures. Based on the analysis of court statistics and international experience (specifically the International Open Data Charter), a path for improving the institution of liability through its personalization is proposed.
